What Happens Without a Will?

When you die intestate (without a will) in Malaysia, your assets are distributed according to the Distribution Act 1958 — not your wishes.

⚠️

Your Family Waits Years

Without a will, your family must apply for a Letter of Administration. This process takes 2-5 years on average and costs thousands in legal fees.

📊

Fixed Distribution Rules

The Distribution Act 1958 dictates fixed portions: spouse gets 1/3, children get 2/3. You cannot choose who gets what.

🏠

Assets May Be Frozen

Bank accounts, properties, and investments are frozen until an administrator is appointed by court. Your family may struggle financially.

👶

No Guardian Choice

Without a will, the court decides who raises your minor children — not you. This may not align with your wishes.

The Distribution Act 1958 (Non-Muslims)

For non-Muslims who die without a will, Malaysian law follows these fixed rules:

SituationDistribution
Spouse + ChildrenSpouse: 1/3 · Children: 2/3 (shared equally)
Spouse + Parents (no children)Spouse: 1/2 · Parents: 1/2
Children only (no spouse)Children: 100% (shared equally)
Spouse onlySpouse: 100%
Parents onlyParents: 100%
No spouse, children, or parentsSiblings → Grandparents → Uncles/Aunts → Government

Islamic Estate Law (Faraid) for Muslims

Muslim estates follow Faraid law, where 2/3 is automatically distributed to designated heirs. However, you CAN write a Wasiat for up to 1/3.

📖

Faraid Rules Apply

Two-thirds (2/3) of a Muslim's estate is distributed according to Faraid — fixed shares to spouse, children, parents, and siblings as prescribed by Islamic law.

📝

Wasiat for 1/3

You can write a Wasiat to bequeath up to 1/3 of your estate to non-Faraid heirs — friends, charities, adopted children, or specific causes.

🏛️

Syariah Court

Muslim estates go through Syariah Court for Faraid distribution. Having a Wasiat speeds up the process and ensures your 1/3 goes where you want.

Common Myths About Wills in Malaysia

❌ "I'm too young to write a will"
Anyone above 18 with assets (even a bank account) should have a will. Life is unpredictable.
❌ "Wills are only for rich people"
If you have a bank account, EPF, vehicle, or property, you need a will. It's not about being rich — it's about being prepared.
❌ "My family will sort it out"
Without a will, your family faces 2-5 years of legal processes, court fees, and potential disputes. Don't put that burden on them.
❌ "It's too expensive and complicated"
With WillBot, you can draft a legally-compliant will from RM 199 in just 15 minutes.
❌ "Muslims don't need wills"
Muslims can write a Wasiat for up to 1/3 of their estate. Without it, that 1/3 follows Faraid too — and you lose the ability to help non-Faraid heirs.
